Abstract
Illegal mining activity in the Amazon and the advance of agribusiness activity in indigenous areas have reignited the debate and it will be up to the constitutional jurisdiction to proceed with the judgment of the lawsuit that discusses a time frame for the demarcation of indigenous lands, which considers, as a reference, the ownership of the areas on the date of enactment of the current constitution.
Resumen
La actividad minera ilegal en la Amazonía y el avance de la actividad agroindustrial en territorios indígenas han reavivado el debate y corresponderá a la jurisdicción constitucional proceder a la sentencia de la demanda que discute el marco de tiempo para la demarcación de tierras indígenas, que considera, como referencia, la titularidad de las áreas a la fecha de promulgación de la constitución vigente.
