The subject in a state of fear and exemption from criminal responsibility

The Law deprives citizens of the option of resolving criminal conflicts outside of what is established by law, although it provides for certain exceptions. They constitute defenses that allow conflict situations to be resolved. Among which is the defense of insurmountable fear. According to this figure, the individual cannot be held responsible despite having the capacity to know and adapt his actions in accordance with the Law, because he was at the time of the incident in an emotional state classified as fear that led him to commit the crime. Due to the above, it is important to consider the mental state of the subject to evaluate whether due to his condition the person committed a crime and, consequently, whether or not he should be exempted from criminal responsibility, or if not, the sanction to be imposed should be mitigated. This defense stands out among the rest of the categories, since its essential element is the psychological state in which the subject was at the time of carrying out the conduct prohibited by law. Hence, it constitutes the subjective basis on which its recognition is based, distinguishing it from the rest of the causes of exemption. The fear that interests the defense under examination, according to the law, must be insurmountable, a term whose interpretation is controversial. Sometimes it is interpreted as that fear that the subject cannot overcome or is unable to overcome psychologically











El Derecho priva a los ciudadanos de la opción de resolver los conflictos penales fuera de lo establecido en la ley, aunque prevé ciertas excepciones. Constituyen eximentes que permiten resolver situaciones de conflicto. Entre las cuales se encuentra la eximente de miedo insuperable. De acuerdo con dicha figura no se le puede exigir responsabilidad al individuo a pesar de tener capacidad para conocer y adecuar su actuación conforme a Derecho, por encontrarse en el momento del hecho en un estado emotivo calificado de miedo que lo conllevó a cometer el delito. En razón de lo anterior, es importante considerar el estado mental del sujeto para evaluar si debido a su condición la persona delinquió y en consecuencia, se debe eximir o no de responsabilidad penal, o en caso contrario, atenuarle la sanción a imponer. Dicha eximente resalta entre el resto de las categorías, en tanto el elemento esencial de la misma lo constituye el estado psicológico en el que se encontraba el sujeto al momento de realizar la conducta prohibida por la ley. De ahí que constituya la base subjetiva en la que se fundamenta su reconocimiento, distinguiéndola del resto de las causas de exención. El miedo que interesa a la eximente en examen, según la ley, debe ser insuperable, término cuya interpretación es polémica. En ocasiones se interpreta como aquel miedo al que el sujeto no puede sobreponerse o es incapaz de vencer psicológicamente.
