PROTECTION OF WATER RIGHTS IN CUBA: A VITAL LEGAL CHALLENGE

In this research, a doctrinal, comparative and legal regulation of water law is carried out, with special reference to the treatment provided by the Cuban legal system. This issue is essential, if one takes into account the international hydrosanitary situation and the increasing involvement of international legal instruments and States in the search for solutions in this regard, as demanded by objectives six and fourteen of Sustainable Development of the 2030 Agenda of the United Nations regarding clean water and sanitation, as well as marine life, respectively. On the subject there are several references from Cuban authors in almost all branches of law, but scarce from the constitutional point of view, being focused on this question the novelty of this research.

It is based on the need to contemplate in the Cuban legal system an adequate and effective legal regulation for water law, if it is based on the recent legislative modifications on the matter in question. That is why the main objective is focused on assessing the legal regulation provided by the Cuban legal system to water law.

The proposed result focuses on contributing to the improvement of Cuban doctrine and law in the field of water law, in order to assist the legal, water, hydrological and hydraulic development of Cuba.

En la presente investigación se realiza un estudio doctrinal, comparado y sobre la regulación jurídica del derecho de aguas, haciendo especial referencia al tratamiento brindado por el Ordenamiento jurídico cubano. Dicho tema resulta imprescindible, si se tiene en cuenta la situación hidrosanitaria internacional y la implicación, mayor cada día, de los Instrumentos jurídicos internacionales y los Estados por la búsqueda de soluciones al respecto, tal y como demandan los objetivos números seis y catorce de Desarrollo Sostenible de la Agenda 2030 de las Naciones Unidas referentes al agua limpia y saneamiento, así como a la vida marina, respectivamente. Sobre el tema existen varias remisiones de autores cubanos en casi todas las ramas del Derecho, pero escasas desde el punto de vista constitucional, estando centrada en esta cuestión la novedad de la presente investigación.

Se parte de la necesidad de contemplar en el Ordenamiento jurídico cubano una regulación legal adecuada y efectiva para el derecho de aguas, si se parte de las recientes modificaciones legislativas sobre la materia en cuestión. Por ello es que el objetivo principal se centra en valorar la regulación legal que brinda el Ordenamiento jurídico cubano al derecho de aguas.

El resultado que se propone se centra en contribuir al perfeccionamiento de la doctrina y del Ordenamiento jurídico cubano en materia de derecho de aguas, en aras de asistir al desarrollo jurídico, hídrico, hidrológico e hidráulico de Cuba.
