The concatenation of the international climatic, economic, health, and ecological crises on the pandemic context establishes the emergence of a constitutional reinterpretation duty based on the foundation of the doctrine of the living instrument. In the new legal era that is inaugurated, a constitutional re-founding of the State is not proposed, rather an ecologically oriented reinterpretation is carried out, aimed at the revision of the current constitutional norms. It is explained from the norms related to the basic functions of the State, which should be subject to a more ecological rereading by jurists at the judicial and administrative level of the Constitution. The three principles that guide the ecological reinterpretation of Constitución are structured: integration, eco-proportionality and ecological progress.
La concatenación de las crisis internacionales climática, económica, sanitaria, ecológica sobre el contexto pandémico establece el surgimiento de un deber de reinterpretación constitucional basado en la fundamentación de la doctrina del instrumento vivo. En la nueva época jurídica que se inaugura, no se propone una refundación constitucional del Estado, más se realiza una reinterpretación ecológicamente orientada a la revisión de las normas constitucionales vigentes. Se explica a partir de las normas relativas a las funciones básicas del Estado, que debería ser objeto de relectura más ecológica por los juristas en el plano judicial e administrativo de la Constitución. Se estructuran los tres principios que orientan la reinterpretación ecológica de Constitución: de la integración, de la eco proporcionalidad y del progreso ecológico.
