Abstract
UNESCO has sparked a whole movement aimed at developing open science among its member states. The ultimate and fundamental result is the formulation of the UNESCO Recommendation on Open Science, approved on November 23, 2021, at the UNESCO General Assembly by government representatives, following a broad worldwide consultation. One of the essential aspects has been to recommend that countries create a regulatory framework to support the process.
Problem to solve: What elements should the regulatory framework on open science in Higher Education Institutions (HEIs) of the Ministry of Higher Education (MES) include to favor its implementation and strengthening?
Objective: To propose a regulatory framework on open science in the HEIs of the MES.
For the study, it was necessary to combine theoretical and empirical methods, such as inductive-deductive reasoning and content analysis, respectively.
Results: The conception and construction of the regulatory framework that guarantees the strengthening of open science in the HEIs of the MES are presented.

La UNESCO ha desatado todo un movimiento en pos de desarrollar la ciencia abierta en sus estados miembros. Como resultado último y fundamental se encuentra la formulación de RECOMENDACIÓN DE UNESCO sobre CIENCIA ABIERTA, aprobado el 23 de noviembre 2021, en la Asamblea General de UNESCO por los representantes de los gobiernos, luego de una amplia consulta a nivel mundial. Uno de los aspectos esenciales ha sido recomendar a los países la creación de un marco normativo que apoye el proceso. Problema a resolver: qué elementos incluye el marco normativo sobre ciencia abierta en las IES del MES que favorezca su implementación y fortalecimiento. Objetivo: Proponer un marco normativo sobre ciencia abierta en las IES del MES. Para el estudio fue necesario la combinación de métodos del nivel teórico y empírico como son el inductivo-deductivo y el análisis de contenido respectivamente. Resultados: se presenta la concepción y construcción del marco regulatorio que garantiza el fortalecimiento de la CA en las IES del MES.
